Welcome to Elevate. By downloading, accessing, or using our app, you agree to these Terms & Conditions. Please read them carefully. If you do not agree, please do not use the app.


1. About Elevate

Elevate is operated by Davoti Solutions AS, a company registered in Norway.

These Terms govern your use of the Elevate mobile application and related services (the “App” or “Service”). By creating an account or otherwise using Elevate, you enter into a binding agreement with us.


2. Eligibility

  • You must be at least 16 years old to use Elevate.

  • By using the App, you confirm that you meet this requirement and have the legal capacity to enter into these Terms.

  • If you are under 18, you should review these Terms with a parent or guardian.


3. Purpose of Elevate (Important Disclaimer)

Elevate provides short, personalized audio sessions designed to support stress reduction, relaxation, sleep improvement, and overall mental well-being.

However:

  • Elevate is not a medical service or device.

  • Elevate does not provide diagnosis, treatment, or cure for any physical or mental health condition.

  • Elevate is not a substitute for professional healthcare.

If you are experiencing mental health issues or other medical concerns, please seek help from a qualified professional.


4. Subscriptions & Payments

  • Some features of Elevate are free. Others require a paid subscription.

  • Subscriptions and payments are handled by Apple App Store or Google Play Store through RevenueCat.

  • By purchasing a subscription, you also agree to the terms of the relevant app store.

  • Renewals, cancellations, and refunds are governed by the app store’s policies.

  • You can manage or cancel your subscription at any time via your app store account settings.

Elevate does not directly store or process your payment details.


5. Your Rights to Use Elevate

  • We grant you a personal, limited, non-exclusive, non-transferable license to use Elevate for your own well-being.

  • You may stream audio sessions within the app, but you may not download, copy, record, share, resell, or otherwise distribute them.

  • All content, including AI-generated audio sessions, text, graphics, branding, and software, is the property of Elevate (Sand Island AS) or its licensors.

  • Any future offline mode will only allow temporary downloads for personal use within the app.


6. Privacy & Data

We respect your privacy. Elevate collects limited information to provide and improve the Service.

Examples include:

  • Account information (such as your email if you create an account)

  • Usage data (sessions history, session favorites, duration, app interactions)

  • Device information (device type, operating system, app version, IP address)

We do not collect sensitive health data unless you choose to share it (e.g., through surveys or integrations).

Your use of Elevate is also governed by our Privacy Policy, which explains in detail what data we collect, why, and your rights under GDPR and other laws. Please read it carefully link


7. User Responsibilities

You agree to:

  • Use Elevate only for personal, lawful purposes.

  • Not misuse the Service (e.g., by attempting to hack, reverse-engineer, or interfere with its operation).

  • Provide accurate information when creating an account.

If you violate these Terms, we may suspend or terminate your access.


8. Termination & Suspension

We may suspend or terminate your account if you:

  • Breach these Terms.

  • Misuse the Service.

  • Engage in illegal or harmful activity.

You may stop using Elevate at any time by deleting your account or uninstalling the app. Upon termination, your license to use Elevate ends immediately.


9. Limitation of Liability

To the fullest extent permitted by law:

  • Elevate is provided “as is” and “as available.”

  • We make no guarantees that Elevate will always be safe, error-free, or available.

  • We are not responsible for indirect, incidental, or consequential damages (such as loss of income, data, or business opportunities).

  • Our total liability to you is limited to the amount you paid for Elevate in the 12 months prior to the claim.

Nothing in these Terms excludes liability where prohibited by law.


10. Changes to the Service

We may update or change Elevate from time to time, including adding or removing features.

We may also update these Terms. If we make material changes, we will notify you in the app or by email.

Continued use of Elevate after changes means you accept the updated Terms.


11. Governing Law & Disputes

  • These Terms are governed by Norwegian law.

  • If a dispute arises, we will first attempt to resolve it through friendly discussions or mediation.

  • If not resolved, disputes will be settled by the courts of Norway.
